I agree that we need to add a poll on how many are already waiting for adjudication in I-485. This will give a better understanding of visa dates will move going forward. I am sure state dept doesn't expect people applying in June to get their GC anytime before 2008.

You can also get a letter from your collegue that worked with that company with all ur job duties mentioned. That serves your purpose I guess.

EB2-I PD: 1/2/06 485@ TSC - MD: 6/30/07 RD: 7/2/07 ND: 10/2/07 AD: 8/6/08
Directly Filed at TSC, Checks cashed but did not receive physical receipt notice
Sequence of Emails:
08/06: CRIS Email, Notice mailed welcoming the new permanent resident
08/07: Soft LUD
08/09: Soft LUD
08/11: Welcome Notice Received via USPS, Post marked 08/08
08/13: CRIS Email, Card Mailed.
08/14: Soft LUD
08/14: Received Cards in the mail, envelope post marked 08/12
To Whom may have COLTS:
- Opened SR for receipt notice in Dec 07
- Feb 08, Received a letter from USCIS stating that they will not be able to generate duplicate notice
- Feb 08, Called USCIS & referenced duplicate notice letter. IO has told me the name check got cleared on Nov 07.

you should be fine. do you have a valid transit visa? i think you need to have one if you are travelling through the European Union.

I received all the three responses to my queries on AP travel. All three of you have confirmed the same. Thanks a lot, I feel a lot better now. Although, as one of you mentioned about a transit visa through the EU, I will be waiting within the Amsterdam airport for 3 hours to take the connecting U.S flight, and so I don't think I need a transit visa. Thanks a lot.

As far as I know paystubs are not part of the required documents for AOS, tax returns are.

Thanks. I will have to return to China because my husband is chinese. If he can not stay here, he would like to go back there and so do I.
Once again thanks for the advice. Let me rephrase my question:
(a) At this point can I file for PERM processing (five months left on H1)?
(b) Case I : If labour does not get cleared within next five months,can I apply for H1 B extension?
(c) Case II : If labour gets cleared within next five months, can I apply for H1B extension?
At this point, I am loooking for extension of one year. Is there any way I can do this?

hi you waited too long to file PERM. To apply for PERM lawyer need considerable time for advertising and other stuff. I would recommend to meet a lawyer since 5 months is too short for both advertising and filing. if your PERM pending more than 365 days then you will be able to extend H1B visa. Even if you were able to file PERM there is no premium I-140 right now
Another option is to go back to china for 1 year and then coming back again on another 6 year H1B visa term(3 years at a time)
best thing is to consult your company lawyer

Well, definitely do not pay anything voluntarily. Wait for them to start legal action. If they don't, you are free. If they do, consult with an attorney and you can always settle outside of court. Non-compete clauses are difficult to enforce, but it is a possibility. It depends on the contract you signed with A.
